Pre-Order Agreement for AquaSense Smart Water Controller
This Pre-Order Agreement ("Agreement") governs your participation in the Nivoryx Systems AquaSense pre-order program. By submitting a pre-order deposit, you agree to be bound by these terms and our main Terms of Service.
1. Pre-Order Process
1.1 Deposit Payment
- A deposit of ₹499 is required to secure your pre-order. The deposit reserves your position in our production queue and will be adjusted against your final kit payment at shipment.
- Whether the deposit is refundable is governed by section 1.2 below (including the September 30, 2026 cutoff), and is consistent with our main Terms of Service.
- Deposit payment must be made through our secure Razorpay payment gateway
- All deposits include applicable GST as per Indian tax laws
1.2 Refund Policy
- Deposits are fully refundable if you cancel on or before September 30, 2026, or until we begin processing your shipment (whichever comes first), subject to section 5.1.
- After that date (or once shipment processing has started for your order), the deposit is non-refundable except where required by applicable law or our Refund Policy for delivered goods.
- Refunds are processed within 5-7 business days to the original payment method
- No deposit refunds after device shipment has begun for your order
2. Product Delivery
2.1 Expected Timeline
- Production is scheduled to begin in Q2 2026
- Shipping is expected to commence in Q3 2026
- You will receive email updates on production and shipping status
- Delivery timelines are estimates and may change due to unforeseen circumstances
2.2 Balance Payment
- Balance payment will be due before device shipment
- You will receive a payment link via email when ready to ship
- Balance payment must be completed within 7 days of receiving the payment request
- Failure to pay balance may result in order cancellation and forfeiture of deposit
2.3 Shipping & Delivery
- Free standard shipping within India for all pre-orders
- Delivery typically takes 3-7 business days after shipment
- You will receive tracking information via email and SMS
- International shipping is not available for pre-orders

3.1 Kit Variants
Hardware kit pricing is quoted on WhatsApp when you inquire. The kits below describe feature tiers — final price depends on configuration, quantity, and availability:
- Smart Kit: Complete solution with all sensors and smart features
- Basic Kit: Essential features with manual override
- Timer Kit: Basic timer control functionality
3.2 What's Included
- AquaSense controller unit with selected features
- Water level sensors (varies by kit)
- Power adapter and cables
- Mobile app access (free basic features)
- Installation guide and documentation
- 1-year manufacturer warranty
4. Subscription Plans
- Basic app features are free and included with your purchase
- Pro subscription (₹99/month) unlocks advanced features
- Business subscription (₹299/month) for commercial use
- Subscriptions start after device delivery and activation
- You can cancel subscriptions anytime without affecting hardware warranty
5. Cancellation & Changes
5.1 Order Cancellation
- You may cancel your pre-order anytime before September 30, 2026
- Full deposit refund for cancellations before September 30, 2026
- No refunds after September 30, 2026, or after device shipment
- Cancellation requests must be submitted via email to support@nivoryx.com
5.2 Order Modifications
- Kit variant changes are allowed on or before September 30, 2026, or until we send your balance payment request—whichever comes first—subject to availability.
- Address changes are accepted until shipment
- Price adjustments may apply for upgrades
- All modification requests are subject to availability
6. Warranty & Support
- 1-year manufacturer warranty on all hardware components
- Warranty covers manufacturing defects under normal use
- Free technical support included for 6 months after delivery
- Extended warranty available for purchase at checkout
- Warranty void if device is modified, damaged by misuse, or exposed to water
7. Risk & Liability
While we strive to deliver high-quality products on time, please note:
- Delivery timelines are estimates and may be affected by manufacturing delays
- We are not liable for indirect damages or consequential losses
- Our liability is limited to the amount paid for the product
- Force majeure events (natural disasters, pandemics, etc.) may affect delivery
8. Privacy & Data
- Your personal information is protected under our Privacy Policy
- Payment information is processed securely through Razorpay
- We may use your email for order updates and important announcements
- You can opt-out of marketing communications anytime
9. Governing Law
This Agreement is governed by Indian law. Any disputes shall be resolved through mutual discussion or mediation in Delhi, India.
